Last spring, property owners in the Primorye region voted to invest in a significant reconstruction project using funds kept in a special account managed by LLC "Olymp." Six months later, they switched to LLC "City-Service" as their managing organization, transferring control of the special account.

However, upon the change, it was discovered that the previous organization had neglected to pay contractors over a million rubles for completed capital repair work, leaving no access to the owner's funds. As a result, LLC "Olymp" requested that LLC "City-Service" settle the debts using the special account funds, which went unanswered.

Unable to find another solution, the old managing company took legal action against LLC "City-Service," demanding that the funds be transferred to their account to cover capital repair costs. The first two instances ruled in favor of the defendant, but the cassation instance supported the plaintiff and granted their claim.

The Arbitration Court of the Far Eastern District ruled that LLC "City-Service," as the new owner of the special account, had not raised any objections to the quality of the work done or its absence. The court found no grounds for refusing to transfer the funds from the special account to pay for the capital repair work.

Thus, the court case ended in favor of the old managing company, setting an essential precedent regarding the management of funds in special accounts.
