Rejection of Lawsuit Regarding Mine Blast Furnace Rehabilitation - Pending Decision on Possible Legal Action Against the Subject Applicant
Fed up with the situation, the owner of an old coal mine in Altenkirchen, Pfalz has failed to halt the ordered remediation work. Recently, the Administrative Court of Neustadt an der Weinstraße dismissed a lawsuit filed by the trade union of the mining corporation Breitenbach GmbH, a subsidiary of the multinational corporation BASF, as reported by court officials.
The issue started back in 2019, when the abandoned mine site saw repeated subsidence and surface collapses. Negotiations between involved parties didn't materialize in an agreement. Consequently, the Structural and Ordnance Directorate (SGD) South imposed measures for securing and remediation, declaring them enforceable immediately, as per the court.
Initially, the plaintiff sought emergency legal protection in vain. The Administrative Court also deemed the lawsuit untenable. Harmful soil changes could be directly linked to the former coal mine. There remains room for an application for a leave to file an appeal with the Higher Administrative Court, concerning the ruling.
