Germany's Retail Association Pursues Legal Framework to Loosen Sunday Shopping Restrictions

Berlin - In an attempt to bring an end to the longstanding debate about individual Sunday openings, the Retail Association Germany (HDE) has taken a substantial step forward. According to the association's president, Josef Sanktjohanser, a constitutional complaint will be filed in the coming months in an effort to establish a stable legal framework on the issue.

The call for legal clarity comes as shops in Germany are only permitted to open on Sundays for specific events such as folk festivals. Trade unions and local churches frequently contest Sunday shopping, often successfully, due to the current regulations. However, the COVID-19 pandemic has exacerbated economic challenges for city centers, prompting calls for change, Sanktjohanser noted.

Many mayors support the move, transcending political affiliations, but the association is facing opposition from religious organizations. Sanktjohanser accused the churches of hypocrisy, pointing out that pilgrimage sites often enjoy generous Sunday opening hours without protests.

The HDE is not advocating for a complete liberalization but seeks moderate opening opportunities within a "limited time frame" from 13:00 to 18:00 on four to twelve Sundays annually. As the Christmas shopping season is expected to commence earlier this year—potentially already in October—the trade association is pinning its hopes on restoring some losses incurred during the pandemic.

To date, there have been no recent legislative changes to Germany's Sunday shopping rules, and the HDE's constitutional complaint is yet to be successful historically. In the event of an unsuccessful complaint, the trade association plans to initiate a constitutional amendment with support across political parties.

Despite ongoing pressure from industry groups and the HDE's initiatives, it is unclear when or if significant changes will be made to the country's Sunday trading laws. Enforcement remains variable, with regional differences in regulation due to state laws. The future of Sunday shopping in Germany hinges on continued advocacy efforts, potential legal challenges, and public opinion shifts.

The finance sector is closely watching the legal proceedings initiated by the Retail Association Germany (HDE) in pursuit of a more flexible Sunday shopping framework, as this could significantly impact business revenue. Meanwhile, the politics of Sunday trading remains divisive, with religious organizations opposing the retail association's proposals, while many mayors across various political affiliations support the move towards moderated Sunday openings.
