Alexandra Strekalova, the authority's spokeswoman, cites their reasoning: "The LBK compared the proposed construction to smaller-scale projects within the neighborhood, rather than the larger developments to the east of Reinekestraße."

Nonetheless, the investor persisted, filing a lawsuit with the Bavarian Administrative Court. The court ruled in favor of the investor, arguing that a reference house with three full floors on the edge of the settlement is appropriate.

Herbert Schneeberger can't help but shake his head at the decision, feeling the whole thing is misguided. He points out that the reference house has only two full floors on the street side. The third floor, he argues, is more like a basement due to its lower position, facing the garden sloping down to the main road.

Andreas Dorsch, from the Bürgerinitiative Gartenstadt Harlaching association, confesses to having seen the rise of taller buildings in green fringe areas. "The initial dam break in Harlaching, for us, was Harthauserstraße 87 in 2010. The height of the four-story building was a cause for concern," he shares. As the project was eventually realized, Dorsch fears a slippery slope for the integrity of Harlaching's green spaces.
