U.S. Appeals Court Reverses Decision, Temporarily Restores Trump's Tariffs

A sudden twist in a legal battle over tariffs enacted by President Donald Trump: an appeals court has temporarily reinstated the tariffs, just less than 24 hours after a U.S. court blocked most of them.

A federal appeals court issued an immediate administrative stay on Tuesday, May 29, 2025. The decision reinstates Trump's extensive tariffs, including a 10% global tariff, "reciprocal" tariffs on more than 60 trading partners, and specific high tariffs on Canadian, Mexican, and Chinese products. The court is currently reviewing the government's request for a longer-term stay.

Last Monday, the U.S. Court of International Trade in New York ruled that Trump did not have the authority to impose these tariffs unilaterally. The lower court concluded that the president's actions exceeded the limited circumstances in which he could act alone, as broad, unlimited tariff authority is reserved for Congress.

The legal wrangling involves almost all tariffs imposed by Trump's administration, including tariffs imposed on what he called "Independence Day" in early April and tariffs on certain goods from Canada, Mexico, and China.

The appeals court's stay means that Trump's tariffs remain in effect at least until the court makes its next decision, likely by mid-June. The underlying legal dispute involves the scope of presidential authority to impose tariffs under emergency powers and could have significant implications for U.S. trade policy and ongoing international trade negotiations.

In a separate but related case, a federal district court also ruled against Trump's tariffs, though that decision is not covered by the appeals court's stay and is subject to its own appeal process.
