City prohibits construction on Malakhov's square park.
In Yekaterinburg's Malakhov square, grandiose constructions like buildings, business centers, or hospitals are forbidden, as the area falls under the Top-1 category, a part of the city's masterplan, 2045. Our site, sai_ru, has shared this information with a journalist from the department of information policy in Yekaterinburg's city hall.
The company's ordered historical-cultural expertise, which conducted zoning and approved construction, holds no merit over the authorities' decision. Only the municipality handles zoning matters.
From 2004 to 2022, the plot was leased by RGS Real Estate. The company aimed to construct a commercial-office complex with a two-story parking lot, but the city government declined to approve the project. Later, the company went bankrupt and the plot was put up for auction for 55 millions rubles. The auction didn't go through, and after half a year, the right to lease the land for 22 millions rubles was purchased by "ЮК Барристер."
Linked to construction firms, "ЮК Барристер" not only enclosed the park with a fence on Luначаrsky street but also planned to establish an object of public-commercial construction on the site (which could’ve been a residential building, hospital, or hotel). The company appealed to the administration to change the land zoning to accommodate their plans, but the application was denied, leading "ЮК Барриster" to file a lawsuit against them, which they subsequently lost.
In response, the lessor removed several trees from the park.

A representative of "ЮК Барrister," Dmitriy Dubovik, claimed that the fence was erected to prevent the land from being used as an unauthorized parking lot and to keep it clean from various household waste. He asserted that the company had no intention of building anything on the site, and only removed the old trees.
"The agreed-upon felling of the decaying trees was approved and permission for the work was granted by the administration of Yekaterinburg on 14.12.2023," explained our site's correspondent, Nikolai Bezsalii.
The same summer, 2024, "ЮК Bарrister" ordered a state expert analysis, which approved construction on a specific area near Malakhov's house. The enclosed courtyard, which had previously been fenced off, gained the status of a Single Zone of Regulated Construction (EZRZ-1). This means that capital projects up to 12.5 meters high (approximately three floors) and underground structures are permissible.
The expert analysis concluded that the new buildings in the courtyard would not obstruct the monument. The experts determined that the project complied with all Russian legislation's requirements.
The journalist from Yekaterinburg's city hall reported that "ЮК Барrister" planned to construct a building within the Single Zone of Regulated Construction (EZRZ-1) near Malakhov's house, following the approval from a state expert analysis. Despite their intentions, constructing any real-estate project, such as a residential building, hospital, or hotel, is not allowed as the area still falls under Top-1 category.
